According to Idaho Code Chapter 16 Title 49, dealers selling vehicles and vessels in the state are required to file a surety bond with the Idaho Transportation Department. The specific bond amount required varies based on the type of vehicles and vessels sold.

Retail dealers in Idaho must have a $20,000 bond. Wholesale-only dealers need a $40,000 bond. A bond amount of $10,000 is required for dealers selling snow machines, motorcycles, ATVs, truck campers and utility vehicles. The obligee is the Idaho Transportation Department. 

The Idaho bond form must be submitted to Dealer Services – Idaho Transportation Department. When applying for a new vehicle or vessel dealer license, this form must be signed by all of the principals as well as the surety bond agent. It also must be notarized. 

The Idaho Vehicle or Vessel bond, also known as auto dealer bond, is valid continuously until it is canceled. The termination notice must be sent to the Idaho Transportation Department no later than 30 days before the cancellation date. 

The Idaho surety bond form for dealers does not have an expiration date. It remains in effect until canceled by the surety bond company. While the bond runs continuously, the dealer must pay the premium annually to the surety company. 

If the surety bond company cancels the bond, the dealer must replace it with a new bond before the cancellation date. The dealer must provide proof of the bond to the Idaho Transportation Department to avoid a license suspension.

To file a claim, the claimant must contact the surety bond company directly. Upon receiving the claim, the surety company investigates the matter to determine the claim’s validity. The claim will be denied if it is not validated. 

If the Idaho surety bond company determines that the claim is valid, the claimant will receive the appropriate funds up to the bond’s penal sum. At that point, the dealer must reimburse the surety bond company for the full amount of the claim.

• Business entity documents, if applicable, that have been filed with the Secretary of State

• Certificate for the completion of a pre-licensing class, for used and wholesale dealers only
• Sales tax number certification
