Contractor License Bond Requirements in West Virginia

The West Virginia Division of Labor is responsible for enforcing the state’s wage bond requirement for obtaining a contractor license as established under Va. Code §21-5-14. It applies to those engaged in construction or mineral work.

The required bond amount is a percentage of four weeks of employees’ wages and fringe benefits. The obligee is the West Virginia Division of Labor. 

Non-resident contractors working in West Virginia are required to post a bond with the West Virginia Tax Division. The state’s surety bond form must be used. The obligee is the State of West Virginia. The bond amount requirement is based on contract value. 

Some municipalities have additional bond requirements; for example, the City of Huntington requires a bond of $500 to $10,000 per building or structure, as determined by the Director of Public Works, for moving structures.
